Terms of Use

These Terms and Conditions govern your use of the MATRICS Learn website, www.matricslearn.org.uk (MATRICS). Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not register for or use the site.  If you have any questions on the Terms and Conditions, please contact matrics@moneyadvicescotland.org.uk.

1. Use of the Site

1.1 MATRICS is provided to you for your use subject to these Terms and Conditions. By using the site you agree to be bound by these Terms and Conditions. References to these Terms and Conditions include:

2. Amendments

2.1 We may update these Terms and Conditions from time to time for legal or regulatory reasons or to allow the proper operation of the site. If we make any changes that we think are major, we’ll notify you via the e-mail address provided by you on registration or via a suitable announcement on MATRICS website. The changes will apply to the use of the site after we have given notice. If you do not wish to accept the new Terms and Conditions you should not continue to use the site. If you continue to use the site after the date on which the change comes into effect, your use of the site indicates your agreement to be bound by the new Terms and Conditions.

3. Registration

3.1 In order to access most sections of the site you need to register.
3.2 It is a condition of registration that you provide your name, contact details, organisation details and FCA registration number. If you do not access the site for nine months or more, we may deactivate your account.
3.3 We reserve the right to terminate your registration if we learn that you have provided false or misleading registration information.
3.4 To register on MATRICS you must be over eighteen years of age.
3.5 You must ensure that the details provided by you on registration or at any time are correct and complete.
3.6 You must inform us immediately of any changes to the information that you provided when registering by updating your personal details in order that we can communicate with you effectively.
3.7 In order for MATRICS to work more effectively and to provide you with the best possible user experience, we use Cookies on this website. You must ensure that your browser settings are set to enable Cookies on this site. Should you have any questions regarding the Cookies that are set, then please view our Cookies Policy.

4. Password and security

4.1 In order to prevent fraud, you must keep your username and password confidential and must not disclose them or share them with anyone. If you know or suspect that someone else knows your username and password you should notify us by contacting  matrics@moneyadvicescotland.org.uk immediately. You are the only person who can use your username and password.

4.2 You agree to immediately notify MATRICS if you believe your password is no longer private or if you suspect any unauthorised use of your registration or password.  If MATRICS has reason to believe that there is likely to be a breach of security or misuse of MATRICS, we may require you to change your password or we may suspend your account.

4.3 Should you cease to be eligible to use the registration-protected areas of MATRICS you must inform MATRICS by emailing us at matrics@moneyadvicescotland.org.uk. Your registration will then be terminated.

5. Intellectual property

5.1 The content of MATRICS is protected by copyright, trademarks, database right and other intellectual property rights. You may retrieve and display the content of MATRICS on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on MATRICS without written permission from MATRICS. 

6. Your use of MATRICS

6.1 You may not use MATRICS for any of the following purposes:
6.1.1 disseminating any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material or otherwise breaching any laws;
6.1.2 transmitting material that encourages conduct that constitutes a criminal offence or otherwise breaches any applicable laws, regulations or code of practice;
6.1.3 interfering with any other person’s use or enjoyment of MATRICS. You will not behave in an abusive manner and will not harass, threaten, or attack anyone. If you disagree with someone’s message, you will not attack that person, but agree to disagree, respectfully;
6.1.4 making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner;
6.1.5 posting any material that is false, misleading, inaccurate, or cannot be substantiated;
6.1.6 posting messages that are clearly outside of the stated topic of that discussion, or disrupt a discussion by, for example, deliberately posting repeated or irrelevant messages or copies of identical messages;
6.1.7 adversely affecting the availability of its resources to other users (e.g. continually posting repetitive text);
6.2 You will, if asked by a representative of MATRICS, cease or amend any posting deemed to breach these Terms and Conditions by the moderators.
6.3 You will be responsible for our losses and costs resulting from your breach of this clause 6.

7. Moderator intervention

7.1 We reserve the right, at our sole discretion, to immediately, without notice edit or remove any message or topic. We will make reasonable efforts to inform you of this action and to indicate our intervention in MATRICS discussions to all users.

8. User Intervention

8.1 If you find any posts to be offensive or objectionable, please advise us by email matrics@moneyadvicescotland.org.uk                       
8.2 If we determine that removal of a post or posts is necessary, we will make reasonable effort to do so in a timely manner.

9. Content Disclaimer

9.1 The views expressed in the posts on MATRICS discussion belong solely to their respective authors and do not necessarily reflect the views of MATRICS or our partner agencies (or their respective network organisations).
9.2 Please remember that, as all registered users can post messages directly on to MATRICS discussions, it is impossible for MATRICS to guarantee the validity of the content of any user posts. MATRICS is not responsible for any user posts or for the consequences of following any advice offered within these posts. It is solely your responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice and other information provided through MATRICS discussions.

10. Availability of MATRICS

10.1 Although we aim to offer you the best service possible, we make no promise that the services at MATRICS will meet your requirements. We cannot guarantee that the services will be fault-free. If a fault occurs with MATRICS you should report it to matrics@moneyadvicescotland.org.uk and we will attempt to correct the fault as soon as we reasonably can.

10.2 Your access to MATRICS may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as we reasonably can.

11. MATRICS’s right to suspend or cancel your registration

11.1 We may suspend or cancel your registration or ability to access MATRICS discussions without notice at our discretion or if you breach any of your obligations under these Terms and Conditions.
11.2 You can cancel your registration at any time by informing us in writing at matrics@moneyadvicescotland.org.uk.  If you do so, you must stop using MATRICS.
11.3 The suspension or cancellation of your registration and your right to use MATRICS shall not affect either party’s statutory rights or liabilities.

12. MATRICS Liability

12.1 MATRICS provides content from other internet sites or resources and while the MATRICS tries to ensure that material included on MATRICS is correct, reputable and of high quality, it does not make any warranties or guarantees in relation to that content. If the MATRICS is informed of any inaccuracies in the material on MATRICS we will attempt to correct the inaccuracies as soon as we reasonably can.
12.2 We have no liability arising from your use of our services for any losses (direct or otherwise). For the avoidance of doubt this includes but is not limited to loss of revenue or profit, loss of data, or business interruption.
12.3 This clause 12 shall not limit or affect our liability resulting from any products sold through MATRICS being found to be unsafe or if something we do negligently causes death or personal injury.

13. Third Party Websites

13.1 MATRICS includes links to other web sites or material which are beyond the MATRICS’s control. The MATRICS is not responsible for content on any site outside MATRICS.

14. Advertising and Sponsorship

14.1 Part of MATRICS may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on MATRICS complies with relevant laws and codes. We will not be responsible to you for any error or inaccuracy in advertising and sponsorship material.

15. Applicable Law

15.1 These Terms and Conditions will be subject to the laws of Scotland. We will try to resolve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so in the courts of Scotland.

16. International Use

16.1 We make no promise that materials on MATRICS are appropriate or available for use in locations outside the United Kingdom, and accessing MATRICS from territories where its contents are illegal or unlawful is prohibited. If you choose to access MATRICS from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.

17. Miscellaneous

17.1 You may not transfer any of your rights under these Terms and Conditions to any other person. We may transfer our rights under these Terms and Conditions to another business where we reasonably believe your rights will not be affected.
17.2 If you breach these Terms and Conditions and the MATRICS chooses to ignore this, the MATRICS will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.
17.3 The MATRICS shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its reasonable control.
17.4 MATRICS Learn is joint owned and operated by Money Advice Scotland, 5 Redwood Crescent, East Kilbride, Glasgow, G74 5PA and Citizens Advice Scotland, Citizens Advice Scotland, Spectrum House, 2 Powderhall Road, Edinburgh, EH7 4GB.
